Terms and Conditions
1. Introduction
These Terms and Conditions (“Terms”) govern the relationship between PROPERTY GIFT AG LTD (referred to as “We,” “Us,” or “Our”) and property owners (“Owners”) and tenants (“Tenants”). By engaging with our services, you agree to comply with and be bound by the following terms.
2. Services
We provide the following services:
Guaranteed Rental Scheme: We lease properties from Owners for a fixed period, guaranteeing rental income regardless of the property’s occupancy status.
Property Management: We manage properties on behalf of Owners, handling maintenance, tenant queries, and rent collection.
Tenant Search: We assist in finding and vetting tenants for Owners under a tenant search agreement.
3. Guaranteed Rental Terms
3.1 Fixed Rental Payments: Under the Guaranteed Rental Scheme, we guarantee the Owner a fixed monthly rental payment for the duration of the contract, regardless of whether the property is occupied by tenants.
3.2 Maintenance Obligations: We are responsible for maintaining the property to a reasonable standard as outlined in the management agreement. However, structural repairs or major works required due to the property’s age or other underlying conditions remain the Owner’s responsibility.
3.3 Contract Termination: Either party may terminate the Guaranteed Rental agreement with 60 notice, provided that all outstanding payments are settled.
4. Property Management Terms
4.1 Responsibilities: We will manage the property on behalf of the Owner, which includes collecting rent, handling maintenance requests, and ensuring compliance with relevant legal obligations (e.g., gas safety certificates, electrical inspections).
4.2 Fees: Our management fee is calculated as 20% of the monthly rental income and is deducted before remitting the balance to the Owner.
4.3 Maintenance and Repairs: Routine maintenance will be managed by us, while major repairs requiring approval will be reported to the Owner before proceeding.
4.4 Termination: Property Management agreements can be terminated by either party with 60 day notice. All pending fees must be settled upon termination.
5. Tenant Search Terms
5.1 Service Scope: Our Tenant Search service includes advertising the property, conducting viewings, and carrying out tenant referencing (credit checks, employment verification, and previous landlord references).
5.2 Fees: A one-time fee of £300 is charged for Tenant Search services, payable upon successful placement of a tenant.
5.3 No Guarantees: We will use reasonable efforts to secure a suitable tenant, but we cannot guarantee that the tenant will meet all criteria or remain in the property for the entirety of the lease.
6. Owner Obligations
6.1 Property Condition: Owners must ensure the property is legally compliant and fit for habitation at the start of any agreement, including all necessary safety certificates.
6.2 Insurance: Owners are required to maintain adequate buildings and liability insurance for the property.
6.3 Mortgage Consent: If applicable, Owners must secure consent from their mortgage provider to rent out the property.
7. Tenant Obligations
7.1 Rent Payments: Tenants are required to pay rent on the agreed date. Late payments may result in additional fees as per the tenancy agreement.
7.2 Property Care: Tenants must maintain the property in good condition, reporting any issues to us promptly.
7.3 Termination of Tenancy: Tenants wishing to end their tenancy must provide the required notice as stipulated in their tenancy agreement.
8. Dispute Resolution
In the event of a dispute between the parties, both sides agree to attempt to resolve the matter amicably. If a resolution cannot be reached, the matter may be referred to a neutral mediator or resolved through legal action in accordance with UK law.
9. Limitation of Liability
We are not liable for any indirect, incidental, or consequential damages arising from the use of our services, except for damages caused by our gross negligence or willful misconduct.
